SiteMinder Plus Special 2022 | Terms and Conditions

These Terms and Conditions apply to the SiteMinder Plus Special 2022 (Promotion).

1. Definitions

Active Agreement means an Agreement which commences, and has not expired or been terminated, prior to the Promotion Period.

Additional Product means:

  • CHANNEL MANAGER
  • PMS INTEGRATION

Agreement means an agreement between SiteMinder and the Customer for the supply of the Products.

Eligible Customer means a customer who purchases a Product under a New Agreement, and does not include an Existing Customer, a Group Customer or Promoter.

Existing Customer means a customer under an Active Agreement.

Group Customer means a customer that:

  1. is part of an affiliated group of Customers represented by a Promoter; or
  2. manages or owns more than one property.

New Agreement means an Agreement that commences during the Promotion Period and has a minimum term of 12 months.

Product means:

  • BOOKING ENGINE
  • WEBSITE BUILDER
  • INSIGHTS

Promoter means a person or entity that negotiates group pricing for Products to be made available to an affiliated group of Customers.

SiteMinder means:

  1. for any Customer principally located in Europe, Middle East or Africa – SiteMinder Distribution Limited (a company incorporated in England & Wales No. 07242801) of 1 Chamberlain Square, CS Birmingham B3 3AX;
  2. for any Customer principally located in the USA, Canada, Central and South America – SiteMinder Hospitality Corporation (a company incorporated in Delaware) of 6505 West Park Blvd, Ste. 306 PMB#411, Plano, TX 75093, USA; and
  3. for any other Customer – SiteMinder Limited (a company incorporated in Australia, ACN 121 931 744) of Bond Store 3, 30 Windmill Street, Millers Point, NSW 2000, Australia.

SiteMinder Plus means the subscription service for Products and Additional Products offered by SiteMinder.

Subscription Fees means the monthly subscription fees payable by a customer for SiteMinder Plus, provided under a New Agreement, excluding any transaction fees.

Term means the term of the New Agreement.

2. Promotion Period

The Promotion runs from 5 April 2022 to 11.59 pm (GMT) on 5 October 2022 (Promotion Period).

3. Offer

3.1

Eligible Customers will receive a 60% discount of the Subscription Fees if the Eligible Customer elects to subscribe to SiteMinder Plus for the provision of the Product(s). (Offer).

3.2

In the event an Eligible Customer accesses Additional Product(s), SiteMinder reserves the right to cancel the Offer and charge the Customer the full Subscription Fees.

4. General

4.1

To the maximum extent permitted by law, SiteMinder and its related bodies corporate, officers, contractors, agents and employees will not be liable for any loss or damage (including direct, indirect or consequential loss), however arising out of or in connection with the Promotion.

4.2

Any personal information collected by SiteMinder in connection with the Promotion will be processed in accordance with its Privacy Policy available at https://www.siteminder.com/legal/privacy/.

4.3

SiteMinder may, in its sole discretion, cancel, terminate, modify, or suspend the Promotion.

4.4

The Promotion is governed by the laws of:
  1. London, United Kingdom, if the Customer is principally located in Europe, the Middle East or Africa;
  2. Dallas, Texas, if the Customer is principally located in the USA, Canada, Central or South America; and
  3. New South Wales, Australia, if the Customer is principally located anywhere else in the world.
